This Privacy Policy discloses the privacy practices for CareDefender, LLC (“Company”), www.thecaredefender.com website, and various related services (together referred to as the “Site”). CareDefender, LLC, the provider of the Services (referred to as “us ” or “we”), is committed to protecting your privacy online. You acknowledge that this Privacy Policy is part of our Terms of Use, and by accessing or using our Site and services, you agree to be bound by all of its terms and conditions. We may receive, collect and store any information you enter on our Site or provides us in any other way. How Do We Safeguard Your Information

We rely on many mechanisms for international data transfers, including but not limited to, contractual clauses and data promulgated by the relevant authorities about whether a country has adequate levels of data protection. Your medial information will be stored using a HIPAA compliant software.

Security and Storage of User and Visitor Information 

We may make use of technical and organizational measures specifically designed to protect your information that is under our control. Employees are aware of and shall follow all of our data privacy policies and procedures. We shall make use of firewalls designed to protect against intruders and test for network vulnerabilities. However, no method of transmission over the internet or method of electronic storage is completely secure and we shall not be liable for any data breach that occurs.

We reserve the right to modify this Privacy Policy at any time for any reason. It is your sole responsibility to check our policies so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the Site. Should we make material changes to this policy, we will notify you here that it has been updated so that you are aware of what information we collect and how it is used.

Policy Scope

This Privacy Policy shall not apply to information that you have provided to third parties. Our Site may direct you to a third-party service; however, disclosure of information to these third parties shall be subject to the relevant third party’s privacy policy. We accept no responsibility for the third-party’s content, procedure or privacy policy. 

PROTECTED HEALTH INFORMATION PRIVACY NOTICE

This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

As we do not provide medical care to you, and we do not bill insurance or any public payor, we are not bound by HIPAA or other privacy laws that are targeted at healthcare providers. We do, however, recognize the sensitive nature of your protected health information (“PHI”). How We May Use and Disclose PHI

Payment. We may use and disclose PHI to create bills and process payments. For example, we may provide a bank with a copy of your payment for which might include your name and address. Or if there is a dispute, your PHI may be part of the dispute resolution process.

Contact. We may contact you by telephone, email, or text message to advise you of upcoming appointments with us, follow-up services, suggestions for how to manage your care, etc. We may use any method of contact to the telephone numbers provided, including automatic dialing devices. Please keep in mind text messaging and email are not secure forms of communication and information contained in texts and emails sent to the telephone numbers or email addresses you provide could be accessed or used by unauthorized third parties. Please do not include any sensitive or private information in any e-mail or survey responses, because such e-mail or survey responses may not be transmitted by secure means and could be intercepted by unauthorized third parties.

Individuals Involved in Your Care or Payment for Care. We may release PHI to a family member or friend involved in your medical care or payment for such care. Additionally, we may release PHI to notify a family member, a friend, or a person responsible for your care of your location and general condition.

Law Enforcement. We may release PHI to law enforcement to comply with a court order, subpoena, warrant, summons or similar process authorized by law; in emergencies, to report crimes (e.g., child sexual abuse), the location of the crime or victims, or the identity, description, or location of the person who committed the crime; to comply with laws regarding the reporting of suspicious wounds and deaths; to identify a victim of a crime; and to identify or locate a suspect, fugitive, material witness, or missing person.

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS applies solely to visitors, users, and others who reside in the States of California, Utah, Virginia, Texas, Connecticut, and Colorado (“consumers” or “you”).     • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or applicable state law, and the Driver’s Privacy Protection Act of 1994.

We obtain the categories of personal information listed above from the following categories of sources:

 

  • Directly from you or our service providers.
  • Indirectly from our Consumers. For example, through information we collect from our Consumers in the course of providing services to them.
  • Directly and indirectly from activity within our Site. For example, from submissions through our Site or Site usage details collected automatically.

Use of Personal Information 

We may use or disclose the personal information we collect for one or more of the following business purposes: 

  • To fulfill or meet the reason for which the information is provided. 
  • To provide you with information, products or Site and services that you request from us, or otherwise communicate with you.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.

When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. Applicable law provides consumers (residents of the aforementioned states) with specific rights regarding their personal information. This section describes your rights and explains how to exercise those rights. 

Access to Specific Information and Data Portability Rights 

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you: 

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: sales, identifying the personal information categories that each category of recipient purchased; and disclosures for a business purpose or identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights 

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable 

consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. 

We may deny your deletion request if retaining the information is necessary for us or our service providers to: 

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug the Site and services or other products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Opt Out of Targeted Advertising

The right to opt out of the processing of your Personal Information obtained from your activities on nonaffiliated websites or online applications for the purposes of targeted advertising may be made directly to us info@thecaredefender.com.

Exercising Access, Data Portability, and Deletion Rights 

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us through our Site.

Only you or a person registered with the state where you reside that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. 

You may only make a verifiable consumer request for access or data portability twice within a 12- month period. The verifiable consumer request must: 

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. 

Response Timing and Format 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

Non-Discrimination 

We will not discriminate against you for exercising any of your rights. Unless permitted by the applicable law, we will not: 

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to Our Privacy Notice 

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will notify you by email or through a notice on our Site.
